1. Anbieter und Geltungsbereich

Anbieter der MainClip-App ist die Liquello GmbH, Am Kronberger Hang 2, 65824 Schwalbach am Taunus, Deutschland. Diese Hinweise erläutern wesentliche Bedingungen zur Nutzung der App. Zwingende gesetzliche Verbraucherrechte bleiben unberührt.

2. Lizenz und Apple-EULA

MainClip wird über den Apple App Store lizenziert. Sofern in App Store Connect keine Custom EULA hinterlegt ist, gilt Apples Standard-EULA für lizenzierte Anwendungen. Diese Websiteinformationen ergänzen die Hinweise, ersetzen aber weder die Apple-EULA noch zwingende gesetzliche Verbraucherrechte.

3. Testphase, Free Mode und MainClip Pro

MainClip bietet eine vollständige Pro-Testphase von sieben Tagen. Danach kann die App im Free Mode mit maximal 30 Einträgen weiterverwendet werden.

MainClip Pro wird als einmaliger Kauf ohne Abonnement über den Apple App Store angeboten. Apple wickelt Kauf, Rechnung, Zahlung und Rückerstattung ab. Liquello ist als App-Anbieter für Inhalt, Funktion und Support der App zuständig.

Der Zielpreis in Deutschland beträgt 29,99 €. Maßgeblich ist immer der aktuell im Apple App Store angezeigte Preis. Preise können je nach Land und Steuer abweichen.

Einmaliger Kauf ohne Abonnement. Die Nutzbarkeit setzt eine kompatible macOS-Version und eine installierte beziehungsweise weiterhin verfügbare App-Version voraus. Zwingende gesetzliche Rechte bleiben unberührt.

4. Nutzerverantwortung

Du bist für Inhalte verantwortlich, die du mit MainClip kopierst, speicherst, exportierst oder wiederherstellst. Die App darf nicht zur Verletzung von Rechten Dritter, zur Speicherung rechtswidriger Inhalte oder zur Umgehung technischer Schutzmaßnahmen verwendet werden.

Bei sensiblen Daten sind Ausschlusslisten und Pausenfunktionen sorgfältig zu konfigurieren. Lokale Backups und die Absicherung des macOS-Benutzerkontos liegen im Verantwortungsbereich des Nutzers.

5. Aktualisierungen und Kompatibilität

MainClip kann aktualisiert werden, um Sicherheit, Kompatibilität, Stabilität und Vertragsmäßigkeit zu erhalten. Änderungen, die über notwendige Aktualisierungen hinausgehen, erfolgen nur im Rahmen der gesetzlichen Voraussetzungen. Gesetzliche Informations-, Aktualisierungs-, Gewährleistungs- und Beendigungsrechte bleiben unberührt.

Einzelne Funktionen können von macOS-Version, Systemberechtigungen, Gerätekonfiguration und Verfügbarkeit des Apple App Store abhängen.

6. Gewährleistung

Es gelten die gesetzlichen Gewährleistungs- und Vertragsmäßigkeitsrechte. MainClip wird mit angemessener Sorgfalt entwickelt. Eine fehlerfreie Erfassung in jeder Drittanbieter-App und jeder Systemkonfiguration kann technisch nicht zugesichert werden.

7. Haftung

Liquello haftet unbeschränkt bei Vorsatz, grober Fahrlässigkeit, Verletzung von Leben, Körper oder Gesundheit, nach dem Produkthaftungsgesetz, bei ausdrücklich übernommenen Garantien und in sonstigen Fällen zwingender gesetzlicher Haftung.

Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten ist die Haftung auf vorhersehbare, vertragstypische Schäden begrenzt. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags erst ermöglicht und auf deren Einhaltung regelmäßig vertraut werden darf. Im Übrigen ist die Haftung bei leichter Fahrlässigkeit ausgeschlossen, soweit gesetzlich zulässig.

Diese Regelung schließt keine zwingenden Rechte aus und stellt keine pauschale Haftungsfreistellung für Datenverlust dar.

8. Anwendbares Recht

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Für Verbraucher gilt diese Rechtswahl nur, soweit dadurch zwingender Schutz des Staates ihres gewöhnlichen Aufenthalts nicht entzogen wird.

3. Trial, Free Mode and MainClip Pro

MainClip provides a seven-day trial of all Pro features. Afterwards the app can continue in Free Mode with a maximum of 30 entries.

MainClip Pro is offered as a one-time purchase without a subscription through the Apple App Store. Apple handles purchase, invoice, payment and refunds. Liquello, as the app provider, is responsible for the app's content, functions and support.

The target price in Germany is €29.99. The current price displayed in the Apple App Store is always authoritative. Prices may vary by country and tax.

The one-time purchase has no subscription. Continued use requires a compatible macOS version and an installed or still-available app version. Mandatory statutory rights remain unaffected.

4. User responsibility

You are responsible for content copied, stored, exported or restored with MainClip. The app must not be used to infringe third-party rights, store unlawful content or circumvent technical safeguards.

Exclusion lists and pause functions should be configured carefully for sensitive data. Local backups and security of the macOS user account remain the user's responsibility.

5. Updates and compatibility

MainClip may be updated to maintain security, compatibility, stability and conformity. Changes beyond necessary updates are made only within statutory requirements. Statutory information, update, warranty and termination rights remain unaffected.

Some functions may depend on the macOS version, system permissions, device configuration and Apple App Store availability.

6. Warranty

Statutory warranty and conformity rights apply. MainClip is developed with reasonable care. Technically, flawless capture in every third-party app and system configuration cannot be guaranteed.

7. Liability

Liquello's liability is unlimited for intent, gross negligence, injury to life, body or health, product liability, expressly assumed guarantees and other mandatory statutory liability.

For a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Essential obligations are those whose performance enables proper execution of the contract and on whose observance the user may regularly rely. Otherwise, liability for slight negligence is excluded where permitted by law.

This clause does not exclude mandatory rights and is not a blanket release from liability for data loss.

8. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only insofar as it does not remove mandatory protection provided by the law of their habitual residence.
